Terms and conditions

By clicking on links to the photo library of the European Broadcast Union (EBU) you are bound by the terms and conditions of use (including reproduction, representation, adaptation, publishing, distribution, social sharing, etc.) of photos (including collages, animations, videos, movies). Read this agreement in its entirety before you download and use any photo.

1. The EBU grants to you, and your employer if you are licensing on behalf of your employer, a limited, personal, non-transferable and non-exclusive right to access the photo(s) in accordance with the terms of this agreement.
2. Use of a photo is subject to the express authorization by EBU Communications.
   1. Submit your request to use a photo by email to ebucommunications@ebu.ch
   2. Provide detailed information about the context (topic, title of magazine, book, web site, blog; format needed; commercial/non-commercial purpose; type of audience, global/regional/local scope…) of use of photos.
3. Once you receive authorization from ebucommunications@ebu.ch the following conditions apply:
   1. Do not use photos of people to promote any product or idea which differs from the actual activity shown in the photographs.
   2. Always treat photos of people with respect and dignity. Please respect the context and meaning of any caption supplied with a photo. While the EBU makes every effort to correctly caption the subject matter of each photo, the EBU does not warrant that such information is accurate. The EBU makes no other warranty, express or implied, including, without limitation, any implied warranties of merchantability or fitness for a particular purpose. The EBU shall not be liable to you or any other person or entity for any general, special, direct, indirect, consequential, incidental, lost profits or other damages arising out of this license or otherwise.
   3. If photos depicting people are used in a publication, always include the following disclaimer note: "Unless otherwise indicated, photographs used in this document are used for illustrative purposes only. Unless otherwise indicated, any person depicted in the document is a "model", and use of the photograph does not indicate endorsement by the model of the content of this document nor is there any relation between the model and any of the topics covered in this document."
   4. Include the mandatory copyright notice "© EBU" when applicable. For example, "© EBU/Jane Doe".
   5. While the EBU makes every effort to obtain written consent from all individuals appearing in a photo available in the EBU photo library, the EBU gives no representation warranty, guarantee or undertaking that any rights, releases or consents which are required, desirable or necessary for reproduction are or will be obtained whether in relation to the use of names, people, intellectual property rights or any underlying works of whatever nature depicted in any photo, or that any waivers of any moral rights have been obtained. You are responsible for ensuring that all necessary rights, model releases or consents and waivers as may be required or desirable or necessary for reproduction have been obtained before you use a photo.
4. Photos are licensed on a non-exclusive basis for a one-time usage. If you would like to re-use the photo in another context, you must request another authorization.
5. The EBU reserves the right to revoke the authorization to access, download and use any photo available on this library at any time and for any reason.
6. You agree to indemnify and hold the EBU harmless against any claim for damages, losses or any costs, including attorneys' fees, arising in any manner whatsoever from your unauthorized use of any photo supplied to you by the EBU or for your breach of any of the terms of this agreement.
7. No variation of any of the terms in this agreement shall be effective unless agreed in writing by the EBU and you.
